Consumer Reports submitted comments to the Connecticut General Assembly in advance of the General Law Committee’s hearing on SB 2, which would place new regulations on generative artificial intelligence and AI used in high-stakes decisions, among other provisions.
Consumer Reports commended lawmakers for taking on this important issue, but believes SB 2 needs to be strengthened in several places in order to fully protect the consumers of Connecticut.
CR urged lawmakers to adopt revisions including:
- Amend the definition of ‘automated decision tools’ so that businesses cannot sidestep regulation
- Ensure consumers get specific, accurate, clear, and actionable explanations of consequential decisions made with the help of automated decision tools. The explanation should, at a minimum, allow a consumer to determine if the decision was based on inaccurate information or inferences about him or her.
- Place a broader duty of care on developers of automated decision tools. The bill places a broader duty of care on developers of generative AI, and this broader responsibility should be placed on developers of automated decision tools as well.
- Provide consumers with enforcement tools – including a private right of action – already offered under Connecticut’s Unfair Trade Practices Act
