How And When Can I Get My Free Consumer Credit Report?

There are two ways to be eligible for a free consumer credit report:

  1. Free annual consumer credit reports is available nationwide. To learn more about how to get your free annual consumer credit report, click here.
  2. You are also eligible to get a free consumer credit report under other provisions of law if:
    • you live in Colorado, Georgia, Maryland, Maine, Massachusetts, New Jersey or Vermont, or

    • you have been denied credit, employment, insurance or housing, public benefits or employment based upon a consumer credit report

NEW RIGHTS–FACT Act Free Annual Consumer Credit Report:

Beginning December 1, 2004, thanks to the federal Fair and Accurate Credit Transactions Act of 2003, (FACT Act), a new program makes free annual consumer credit reports available nationally, simply for the asking.

Your rights under the FACT Act are in addition to any rights you may already have to a free consumer credit report under existing law if you live in a state that provided for a free credit report before the federal FACT Act or if you have been denied credit, employment, insurance, housing or public benefits based upon a consumer credit report.

Under the FACT Act program, you are entitled to one free consumer credit report annually from each of the three nationwide consumer credit reporting agencies: Equifax, Experian, and TransUnion.

OTHER WAYS TO GET A FREE ANNUAL REPORT

FREE STATES: Even before the new nationwide free credit report you were already eligible for a free annual consumer credit report if you live in Colorado, Maryland, Maine, Massachusetts, New Jersey or Vermont. If you live in Georgia, you are eligible for two consumer credit reports per 12 months.

FCRA: You are also entitled to a free consumer credit report under the Fair Consumer Credit Reporting Act (FCRA) if any of the following apply:

  • A consumer credit report was used as the basis for turning you down for a loan, insurance policy, or job, and you request a free consumer credit report within 60 days of being notified of the denial by the creditor, insurance company or potential employer or other source that turned you down. The source that turned you down must tell you why you were denied. You should include that information in your request to the consumer credit reporting agency when you ask for a free report.
  • You are unemployed and will apply for unemployment within 60 days from the date you certify your unemployment with the consumer credit reporting agency from which you seek the report;
  • You receive public assistance; or
  • If you believe your file contains inaccurate information because of fraudulent activity, you can file a fraud alert.
