Consumer Reports submitted a letter to the U.S. Senate Commerce Committee in advance of their hearing, “Revisiting the Need for Federal Data Privacy Legislation.” We highlighted the need for privacy protections particularly in light of the COVID-19 crisis, which has increased consumers’ reliance on internet service providers, Google platforms, and teleconferencing services for work and school. We also explore Chairman Wicker’s new privacy legislation, Setting an American Framework to Ensure Data Access, Transparency, and Accountability Act (SAFE DATA Act), noting that it would advance key baseline privacy protections such as the right to access, delete, correct, and opt out of the sale of personal information, and additional protections for sensitive data, while calling on the Chairman to consider a number of adjustments to ensure that the bill is workable for consumers and to eliminate inadvertent loopholes that companies could exploit to avoid reforming their data practices.
